On August 13, 2017, Detective Kurtis Wallace conducted traffic stop on a moped for not having a registration. During the stop, Detective Wallace came into contact with the driver, identified as Mark A. Bear Age 53 of Madison Indiana. Detective Wallace was familiar with Bear through past investigations and knew that Bear was recently investigated for Dealing in Methamphetamine. Detective Wallace also knew that Bear had recently been in the Indiana Department of Corrections for Possession of Methamphetamine Pre-Cursors.
Detective Wallace began investigating the stop and identified the VIN number on the moped. As Detective Wallace checked the VIN, Bear picked up a black zipper bag near the front of the moped. Detective Wallace asked Bear for consent to search the zipper bag, but Bear denied consent. According Wallace, Bear appeared nervous. Detective Wallace then radioed for a K9 assistance. Bear agreed to open bag and stated it only contained cigarettes. When Bear opened the bag, Detective Wallace observed the end of a pipe he knows to be used to ingest methamphetamine, inside the bag. These types of pipes are often referred to as a “chicken bone”. Bear admitted to having a methamphetamine pipe inside the bag. Bear reluctantly provided Detective Wallace the zipper bag.
During a search of the bag, Detective Wallace located an operational digital scale, U.S. currency, a plastic container that contained a white substance, and plastic bag containing a crystal-like substance. These substances found tested positive for methamphetamine. The total amount found had a weight of over 10 grams. Based on the investigation, Bear was placed under arrest.
